Federal Court dismisses unfair dismissal & bullying case against SBS

MELBOURNE, 19 October 2022: Judge Cameron of the Federal Court (Federal and Family Court of Australia – Division 2 general Federal Law) on 6 October 2022, dismissed an unfair dismissal case against SBS, filed by Pallavi Jain, a journalist at the SBS Hindi. SBS terminated Pallavi’s employment on 9 December 2019. Earlier, an external investigation found Pallavi was bullied and harassed while working under Executive Producer Kumad Mirani. Merani denied the allegations.

In a 43-page judgment, Judge Cameron dismissing the case said, ” The allegations that SBS contravened the FW Act have not been made out. Consequently, the application will be dismissed.”

Pallavi Jain in a Tweet today says, ” Has been a traumatic journey n fighting my own case was difficult but I thank those who vocally/silently supported me. I move forward with hope with my resolve to fight work-place bullying even stronger.”

Sydney Morning Herald (Oct. 19, 2022) says: ” Merani, who has since retired from SBS, said she was satisfied with the judgment and while “every story has two sides”, Merani maintains that “a dignified silence makes the most powerful statement”.

“I have dealt with the issue from start to finish with complete dignity,” she said. “My community has the fullest faith in me. I am very happy with my life.”
